Kebbi Court Remands Two Suspects for Alleged Conspiracy, Theft, Brigandage

The High Court 9, sitting in Birnin Kebbi, Kebbi State, has remanded Samaila Adamu Argungu and Lawali Sani in a correctional facility for alleged conspiracy, theft in a dwelling house, and belonging to a gangs of brigands. The duo was arraigned before Her Lordship, Hon. Justice Halima Ibrahim Umar, on Three count charges contrary to sections 60 (sub-3), 274, and 292 (sub-2) of the Kebbi State Penal Code Law, 2021.

According to the prosecution, led by Lawal Hudu Garba, SAN, from the State Ministry of Justice, the defendants were arrested on February 22, 2025, at Gandatobe village under Kambaza Districts by Vigilante Group Nigeria (VGN) and handed over to Gwandu Divisional Police Headquarters.

"We are here to prove the alleged offenses charged against the defendants," said Lawal Hudu Garba, SAN, during the proceedings.

The prosecution team presented five witnesses and tendered several exhibits, including one Golf 3 model red Volkswagen, one motorcycle, three mobile phones (Redmi, Techno, and Itel), through the police exhibit keeper, who testified as PW3.

Barrister Nasir Gulma, counsel to the first defendant, and Barrister Muhammad Usman of A.A. Filgila Law Chamber, counsel to the second defendant, cross-examined all the prosecution witnesses.

During the proceedings, the prosecution sought to tender a bond order form for the release of a motorcycle mentioned as part of the exhibit. However, Barrister Nasir Gulma objected to the tendering of the document, stating, "The exhibit keeper is not the maker of the said document sought to be tendered, and he has no signature on the document."

The second defendant's counsel, Barrister Muhammad Usman, aligned with the submission of the first defendant's counsel, objecting to the tendering of the document and reserving his legal arguments for final written address.

After hearing from both parties, Her Lordship, Hon. Justice Halima Ibrahim Umar, remanded the accused persons in a correctional facility and adjourned the matter to February 17, 2026, for continuation of hearing.

"We will address the court on the objection raised on the tendering of the bond order form at the address stage," said Barrister Nasir Gulma.
