Breaking: A Chief Magistrate Court in Argungu, Kebbi State, is embroiled in a legal battle over a criminal conspiracy, trespass, and theft case against Ex-Council Chairman Aliyu Bagobiri, Aminu Tsalhatu, and Alhaji Salihu Ahmed (KC).
Defendants' counsel, Barrister Abdul Rahman Dahiru, filed a preliminary objection, citing abuse of court process, forum shopping, and jurisdiction issues. Complainants' counsel, Barrister Nasir Salihu Gulma, countered with a counter-affidavit.
The defendants denied paragraphs 1-5 of the notice of preliminary objection, arguing only the 1st defendant is involved in Case No. KB/HC/AR/4CV/2024. The appeal is pending before the Court of Appeal, Sokoto Division.
Counsel for the complainants urges the court to dismiss the preliminary objection and allow the case to proceed, arguing it doesn't constitute abuse of court process. The court adjourned till Jan 6, 2025, for ruling on jurisdiction
