BIRNIN KEBBI - The Kebbi State High Court 5, sitting in Birnin Kebbi, has convicted and sentenced three persons to death by hanging for armed robbery and to life imprisonment for conspiracy to commit armed robbery.
Delivering judgment on Tuesday in Case No. KB/HC/55C/RF/2024, Hon. Justice Hassan Usman held that the prosecution proved its case beyond reasonable doubt against the defendants.
The convicts are: Abubakar Zaki alias Gwanja, Sanusi Zaki alias Danhamidu, and Jafar Sani alias Ali Baba. A fourth accused, Mudassir Alh. Yayo, remains at large.
The court found that on or about the 18th day of March, 2024, at about 2100 hours, along Makera-Argungu Road within Birnin Kebbi Local Government Area, the defendants conspired amongst themselves and committed armed robbery.
According to the particulars of the offence, the defendants, while armed with sticks, blocked one Alhassan Garba, assaulted him with a stick causing him to fall, and robbed him of one Bajaj motorcycle, red in colour, valued at N325,000.00.
In its judgment, the court convicted the three defendants on two counts. “On count one, conspiracy to commit armed robbery contrary to Section 6(b) of the Robbery and Firearms (Special Provisions) Act, 2004, each of you is hereby sentenced to life imprisonment,” Justice Usman ruled.
“On count two, armed robbery contrary to Section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, 2004, the sentence of this court upon you is death by hanging,” the judge pronounced.
The Director of Public Prosecutions, Lawal Hudu Garba, SAN, appeared for the prosecution with Hayatu Isah Muhammad, CSC. The 1st Defendant was represented by A. A. Fingilla, Esq, while Ibrahim Jibrin, Esq, represented the 2nd and 3rd Defendants.
Section 1(2)(a) of the Robbery and Firearms (Special Provisions) Act, 2004 prescribes death penalty for anyone found guilty of armed robbery, while Section 6(b) provides for life imprisonment for conspiracy to commit armed robbery.
The court ordered that the sentences shall run concurrently.
