Federal High Court Adjourns Yabo/Shagari APC Primary Suit To July 19

---Plaintiff presents two witnesses as court grants defense request for more time

The Federal High Court, Sokoto Division, has adjourned further proceedings in the suit challenging the conduct and outcome of the All Progressives Congress, APC, primary election for Yabo/Shagari Federal Constituency to July 19, 2027.
The adjournment was ordered on Thursday by the presiding Judge, Hon. Justice Ahmad Muhamoud Gama, to afford parties the opportunity to conclude the taking of evidence.
The plaintiff, Abubakar Umar Shagari, instituted the action seeking the court’s determination on the validity of the declaration of Prof. Musa Garba Maitafsir as winner of the APC primary election conducted in the constituency.
At the resumed hearing, learned counsel for the plaintiff, Barr. Y.Y. Gwazawa, called two witnesses. The witnesses, Aminu Musa and Murtala Shagari, were led in evidence-in-chief, adopted their respective written statements on oath, and tendered same as exhibits before the court.
Under cross-examination, the witnesses were tested by learned counsel for the 1st, 2nd and 3rd defendants respectively. Appearance was entered for the 1st defendant by Barr. Jacob Ochidi, SAN, for the 2nd defendant, APC, by Barr. Bashir Muazu Jodi, and for the 3rd defendant by Barr. I.Y. Tijjani.
Upon conclusion of cross-examination, counsel for the plaintiff informed the court of his intention to call a further witness, but stated that the said witness was not present in court.
Arising therefrom, learned counsel for the 2nd defendant, Barr. Bashir Jodi, moved an application for adjournment.
Addressing journalists after proceedings, Jodi said:  “The plaintiff’s counsel has closed with two witnesses today. He informed the court that he still has one more witness to call, but that witness is not available. In the circumstances, we applied for an adjournment, which was graciously granted by the court.”
In a short ruling, Justice Gama adjourned the matter to July 19, 2027, for continuation of hearing.
The suit, amongst other reliefs, prays the court to set aside the purported declaration of Prof. Musa Garba Maitafsir as winner of the APC primary election for Yabo/Shagari Federal Constituency.
